PERM Labor Certifications Issued Electronically due to COVID-19

Due to the COVID-19 national emergency, the Office of Foreign Labor Certification (OFLC) will temporarily issue all PERM labor certification documents electronically.

As of March 25, 2020, OFLC has issued PERM labor certification documents online to minimize in-person contact and reduce the risk of disease transmission. The agency plans to continue issuing PERM labor certification documents electronically through June 30, 2020.

OFLC has established protocols for this temporary period. First, it will email employers or their authorized agents a Final Determination letter and a FORM ETA-9089. The agency will mail the documents to those who can’t receive them electronically. The employer, employee, and preparer (if applicable) must sign and date the documentation to file the applicant’s petition. USCIS will accept the signed documentation as proof of “original labor certification” issued by OFLC.
