Certain Applications Subject to New Requirements

August 28, 2019 | Malaysia

Companies and foreign nationals applying for certain immigration passes through MDEC (Malaysia Digital Economy Corporation) are subject to new requirements, as follows:

New requirement for newborns
Effective immediately, foreign nationals with a newborn child born in Malaysia who are applying for a Dependent Pass (DP) for the child must also apply for a Special Pass (SP) for the child. The SP will enable the child to stay in Malaysia while awaiting processing of the DP.

For children aged one month to six months, the SP application must be filed with the MDEC Immigration Unit. For children older than six months, the SP application must be filed with the Enforcement Unit of the Immigration Department in Putrajaya.

Note that the SP application documents must also be submitted in support of pending DP applications that were approved before this change took effect but have not yet been endorsed (Stage 2). Specifically, the SP application cover letter, the SP declaration form, Format A and a bank draft for RM 100 payable to Ketua Pengarah Imigresen Malaysia must be submitted.

New requirement for Nigerian nationals
Effective September 1, 2019, companies that apply through MDEC for Employment Passes for Nigerian nationals will need to ensure certain supporting documents are legalized by the Malaysian High Commission in Nigeria. The documents to be legalized include degree, marriage and birth certificates. Note that MDEC will not return the documents.
