Effective immediately, the Kenyan government will no longer grant work permits and passes to foreign nationals present in Kenya. Entry and work permit applications must be filed and approved while the foreign national is outside the country. No foreign national with a pending application is to be present in Kenya, including employees with expired permits or passes waiting for extension approval.

This is a long-standing requirement per the Citizenship and Immigration Act that has not always been enforced. A directive was issued on December 10, 2018 enforcing the law.

Foreign nationals found in Kenya without authorization will be arrested and deported and permitted to re-enter only once their permit or pass has been issued.

Other Changes

The Cabinet Secretary has announced that if qualified Kenyan candidates are available for a position, a foreign national cannot be hired into it.

The government has also limited the validity period of visa extensions to one month.
