New Record Keeping Requirement for Tier 2 Sponsors

Per updated guidance for sponsors from the Home Office, Tier 2 sponsors are now required to keep a record of their Tier 2 employees’ admission dates to the UK. The record must be created online or on paper within 30 days of the first day of the visa’s validity period. This was previously not required; however, employers were previously, and still are, required to keep a copy of documentation evidencing each foreign national’s right to work.
The new requirement poses a particular challenge to the employers of foreign nationals that enter the UK using ePassport gates, as ePassport gates provide no paper record of entry to make a copy of. Such employers will need to confirm the entry date with the traveler and then record it. Travelers that do not use ePassport gates are given an entry date stamp in their passport that can easily be copied.
As background, ePassport gates offer automated immigration inspection and expedited entry using a facial recognition system at UK airports and Eurostar terminals in Brussels and Paris. Qualifying UK, EEA and Swiss nationals as well as qualifying nationals of Australia, Canada, Japan, New Zealand, Singapore, South Korea and the United States can use ePassport gates.
